Incognito-Vault Attribution & Compliance License (IVACL)

This software is licensed under the Incognito-Vault Attribution & Compliance License (IVACL). By accessing, using, modifying, or distributing this software, you agree to adhere to the following terms and conditions:

1. Copyright and Ownership

All rights to this software are reserved by the developer, ParseSphere Innovations.

2. Permitted Usage

  • Any individual, organization, or enterprise may use this software for any lawful purpose, including personal, educational, commercial, or research applications.
  • Proper attribution to ParseSphere Innovations must be provided in all derivative works, usage, or public dissemination of the software.

How to Provide Proper Attribution:

To comply with the attribution requirement, credit must include the following details:

  1. Name of the Developer: ParseSphere Innovations.
  2. Statement of Contribution: Acknowledgment that the software or its components were developed by ParseSphere Innovations.
  3. Location of Attribution:
    • In Digital Outputs: If the software is used in any form, the credit must appear in a visible location such as:
      • An "About" or "Credits" section.
      • A footer or splash screen (if applicable).
    • In Documentation: If the software is documented (e.g., user manuals, project readme files), the credit must be included prominently within the documentation.
    • In Marketing/Promotional Materials: If the software is referenced in promotional content, credit must be included within the material.

Example of Proper Attribution:

This software is powered by technology developed by ParseSphere Innovations.

Failure to provide proper attribution constitutes a violation of this license.

3. Prohibited Activities

A. Misrepresentation, Modification, Duplication, or Distribution:

  • Misrepresenting the origin or authorship of this software is strictly prohibited.
  • Unauthorized modification, duplication, or distribution of this software or its source code, whether in original or modified form, without explicit written permission from ParseSphere Innovations, is prohibited.
  • This includes, but is not limited to:
    • Reverse engineering, decompiling, or disassembling the software.
    • Redistributing modified versions of the software without prior consent.
  • Such actions may result in legal consequences under applicable intellectual property laws, including, but not limited to:
    • Section 403 (IPC): Dishonest misappropriation or conversion of property.
    • Section 405 (IPC): Criminal breach of trust.
    • Section 420 (IPC): Cheating and dishonestly inducing delivery of property.
    • Section 66 (IT Act): Computer-related offenses.

B. Malicious or Fraudulent Use:

  • The software must not be used for malicious, harmful, or fraudulent purposes.
  • Malicious or fraudulent use includes, but is not limited to:
    • Using the software to cause damage to individuals, systems, or networks.
    • Engaging in fraudulent activities, including data theft, hacking, or misrepresentation.
    • Using the software to breach security systems or engage in illegal surveillance.
  • Any misuse leading to fraud, harm, or illegal activity will be prosecuted under applicable laws, such as:
    • Section 420 (IPC): Cheating and dishonestly inducing delivery of property.
    • Section 463 (IPC): Forgery as the act of making a false document or electronic record with fraudulent intent.
    • Section 468 (IPC): Forgery of documents for the purpose of cheating.
    • Section 66D (IT Act): Punishment for cheating by personation using computer resources.

4. Compliance and Liability

  • Users must ensure their use of this software complies with all local laws, regulations, and ethical guidelines.
  • Any violation of this license may result in legal action under the applicable laws. ParseSphere Innovations reserves the right to pursue remedies under intellectual property laws for any breach.
  • ParseSphere Innovations is not responsible for any direct or indirect damages caused by non-compliance with this license. Users bear full responsibility for ensuring compliance with relevant legal and ethical standards.
  • Indemnity Clause: By using this software, users agree to indemnify and hold harmless ParseSphere Innovations from any claims, damages, losses, or liabilities arising from misuse, modification, or distribution of the software in violation of this license.

5. Disclaimer

  • This software is provided "as is," with no warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • ParseSphere Innovations shall not be held liable for any damages, claims, or liabilities arising from the use, modification, or redistribution of this software, including but not limited to:
    • Data loss or corruption.
    • Financial losses or damages to business operations.
    • Legal liabilities resulting from the unlawful use or distribution of the software.
  • Users are responsible for ensuring their usage complies with local laws and regulations and for bearing the risk of any negative consequences resulting from their use.

6. Acceptance

  • By accessing, using, modifying, or distributing this software, you acknowledge that you have read, understood, and agreed to the terms outlined in this license.
  • If you do not agree to these terms, you must immediately cease using the software and refrain from any further modifications, distribution, or usage.

7. Dispute Resolution and Jurisdiction

  • Any disputes arising from or related to this license shall be resolved through binding arbitration under the Indian Arbitration and Conciliation Act, 1996.
  • The arbitration will be held in New Delhi, India, unless the parties mutually agree to an alternative location. The proceedings will be conducted in English.
  • If the dispute cannot be resolved through arbitration, the parties agree to submit to the exclusive jurisdiction of the courts in New Delhi, India.
  • This provision applies regardless of the user’s country of residence or location of business.

8. International Compliance

  • For users outside of India, compliance with equivalent local laws governing intellectual property, fraud, and misuse is mandatory.
  • In the event of a conflict between local laws and the terms of this license, the terms outlined in this license shall prevail, and any disputes will be subject to the dispute resolution process as described in Section 7.
  • International users are responsible for ensuring that their use of this software does not violate any laws or regulations in their jurisdiction.

9. Future Updates

This license may be updated or amended in future versions. Users may choose to comply with this version or any subsequent version published by ParseSphere Innovations.

10. Revocation Clause

ParseSphere Innovations reserves the right to revoke this license if the terms are violated.
